Terms of Service

These Terms of Service ("Terms") govern your access to and use of AskMana ("Service"), operated by MANA BİLİŞİM PRODÜKSİYON VETERİNERLİK TARIM CANLI HAYVAN VE HAYVANSAL ÜRÜNLERİ SANAYİ TİCARET LİMİTED ŞİRKETİ ("we", "us", "our"), a limited liability company registered in Türkiye. By creating an account or using the Service, you agree to these Terms.

1. The Service

AskMana is a multi-tenant SaaS that lets businesses embed an AI chatbot widget on their website. The bot answers visitor questions using the customer's own knowledge base and optional connectors (e.g. WooCommerce). The Service is delivered over the public internet from servers located in Falkenstein, Germany.

2. Accounts

  • You must be at least 18 years old and legally able to enter a contract.
  • You are responsible for keeping your password confidential and for all activity under your account.
  • You must provide accurate billing information and a working email address.
  • One workspace per registered business entity. We may suspend duplicate workspaces created to evade plan limits.

3. Plans, trial and billing

  • New workspaces receive a 7-day free trial. No credit card is required to start the trial.
  • After the trial, continued access requires an active paid subscription. Plans are billed in advance, monthly or annually, via Paddle.com Market Limited acting as Merchant of Record.
  • Plan limits (messages per month, knowledge base size, connectors) are listed on the pricing page. Exceeding a limit may trigger soft-throttling or an upgrade prompt; we will not bill overage without your consent.
  • You can request a full refund within 14 days of any charge under our Refund Policy, aligned with the Paddle Buyer Terms.
  • Prices may change with at least 30 days' notice by email; new prices apply at your next renewal.

4. Your content

You retain all rights to the data you upload (knowledge base articles, integration credentials, conversation history). You grant us a limited license to process that data solely for the purpose of providing the Service to you. We do not use your content to train any AI model and we do not sell or share it with advertisers. See our Privacy Policy for details.

5. Acceptable use

You agree not to use the Service to:

  • Generate, store or transmit content that is illegal, infringing, defamatory, or sexually explicit involving minors.
  • Send spam, phishing messages, or automated abuse via the widget.
  • Probe, scan or test the vulnerability of our infrastructure without prior written consent.
  • Resell or sublicense the Service to third parties without a written reseller agreement.
  • Bypass plan limits, trial restrictions, or rate-limits using automated tools, multiple accounts, or proxy networks.

We may suspend or terminate any workspace that violates this section, with or without prior notice depending on severity.

6. AI provider keys (BYOK)

Some features require you to provide your own OpenAI or Google Gemini API key. You are responsible for usage charges incurred on your provider account. We encrypt your keys at rest using AES-256-GCM and never log or display the plaintext. If a key is compromised through our fault, we will notify you within 72 hours.

7. Service availability

We target 99.5% monthly uptime, excluding scheduled maintenance announced at least 48 hours in advance. The Service is provided "as is" without uptime guarantees during the free trial. We are not liable for downstream outages of sub-processors (Hetzner, Paddle, OpenAI, Google, Resend).

8. Suspension and termination

  • You may cancel anytime from your dashboard. Cancellation takes effect at the end of the current billing period.
  • We may suspend your account if payment fails after three retries, or terminate immediately for breach of Section 5 (Acceptable use).
  • On termination, your data is retained for 30 days for export, then deleted. Payment records are retained as legally required.

9. Disclaimers

The Service is provided "as is" and "as available". We do not warrant that the AI responses are accurate, complete, or suitable for any particular purpose. You are responsible for reviewing AI output before relying on it for business decisions.

We disclaim all implied warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by applicable law, our total aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue.

11. Indemnification

You agree to indemnify and hold us harmless from any claim arising out of (a) your violation of these Terms, (b) your content uploaded to the Service, or (c) your end users' use of the widget you embedded.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email at least 30 days before they take effect. The "Last updated" date at the top reflects the latest revision. Continued use of the Service after the effective date constitutes acceptance.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. Disputes will be resolved exclusively by the courts of İstanbul, Türkiye, except where applicable consumer-protection law of your country of residence grants you a non-waivable forum.
